Data Privacy is a matter of confidence and your confidence is important to us. HOMA takes serious notes of your Data Privacy. Thus, the provider of this App, HOMA Pumpenfabrik GmbH (‘HOMA’), totally adheres to all applicable data privacy laws and regulations while processing your personal data within HOMApp (‘App’). In the following, please find more information about the processing and use of personal data within this App.
Anonymous Data Processing
Since there is no different information given within the following sections, this App generally does not require any further collection, processing or use of personal data.
Personal Data
The definition of ‘Personal Data’ is given by law. Within this meaning any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as your name, your street address, your email address, your IP-Address, Mobile ID, Usage of the App or your local position.
Access-Rights
To provide you with our service and offer reliable technical solutions we need the following access-rights and information. We will not access on these features and information without your explicit consent. Depending on the individual operating system of your mobile device, you are enabled to manually revoke the granted access-rights within the settings of your mobile device. For further information please read the instructions of your mobile device. Please note, that our App may not work objectionable without granting us the required access-rights.
The legal basis for this is Art. 6 para. 1 f GDPR. The legitimate interest results from the purposes stated in each case. The data is stored on our servers until the purpose is fulfilled.
Android:
To use the app, the following authorizations are required for the purpose listed below (these are requested technically before the first use):

Data-sharing within the App
This App provides you with the possibility to share information directly out of the App by using Third-Party services (e.g. Messaging Services etc.). Since these providers have access on personal information about you (e.g. your identity or your local position etc.) and may submit further information please note, that data-sharing by you is solely effected voluntarily and with your explicit consent. For further information please see also the data privacy policy and instructions provided by the selected service provider. HOMA does not have any influence on the process of data collection and processing of these service providers, nor does the App itself has any possibilities to do so.
Data-download
Within our App you have the possibility to download specific data-files from an external server hosted by HOMA. The download can be effected automatically or manually. You can find the settings to organize an automatically download within the App-settings. If you choose the manual download data-download can solely be effected voluntarily and with your individual explicit consent. However, please note, that any data-download is solely effected voluntarily and with your explicit consent.
If you decide to download data from the external server, your IP-address will be submitted to and logged on the server by technical issues. HOMA will only access on the log-files in any suspicious case of abuse of the App’s functionalities.
Logging of ID
If you are a service technician and you submit data or instructions to the pump control, your mobile-ID or Mac-Address is submitted additionally in an encrypted form and logged on the control unit, to verify your identity. These information is only available on the control unit and is not submitted to the mobile device of the normal user. HOMA will only read out this information in a suspicious case of abuse. Any decryption or eavesdrop of this information is impossible.
Access on local position (Android)
If you use our App on Android, you may grant our App access on your local position. This depends on technical issues, since Bluetooth and especially Bluetooth LE are also used to determine the users local position. We will not, under no circumstances and for any reason, access on, process or submit any information concerning your local position.
Please note, that above all, there could be the theoretical possibility for third parties to access on your local position in special cases as we have already informed you under the topic ‘Data-sharing within the App’.
Your rights
You have the right to information, correction and deletion, blocking and restriction of processing. If processing is based on your consent, you have the right to withdraw your consent at any time with effect for the future in whole or in part.
Right if data processing is based on a legitimate or public interest: Pursuant to Art. 21 para. 1 GDPR, you have the right to object at any time to the processing of personal data concerning you on the basis of Art. 6 para.1 lit. e GDPR (data processing in the public interest) or Article 6 para.1 lit. f GDPR (data processing to protect a legitimate interest), this also applies to profiling based on this provision.
In the event of your objection, we will no longer process your personal data unless we can prove compelling grounds for processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
Right to lodge a complaint: You have the right to lodge a complaint with a supervisory authority if you believe that the processing of this data violates the General Data Protection Regulation (GDPR).
Provider of the operating System
While using your mobile device, the provider of the operating system may collect, process or use additional personal information according to their Terms of Use. Therefore, please consider their current privacy statements and settings as well.
Amendments to the privacy statement
We reserve the right to change, amend and develop this Privacy Policy at any time adhering to the applicable data protection laws and regulations.
